1. Introduction
These Terms & Conditions (“Terms”) govern all bookings and stays at Chalet Balthazar, 14 Chemin de la Gare, 1884 Villars, Switzerland (“Chalet Balthazar”, “we”, “us”, “our”), made via our website, www.villarsapartments.com.
Before completing payment, you will be asked to confirm your acceptance of these Terms. If you do not agree to these Terms, please do not proceed with your booking.
2. Definitions
- “Property” — Chalet Balthazar, together with its furnishings, fixtures, and grounds
- “Guest” — the person making the booking and all persons staying at the Property
- “Booking” — a confirmed reservation for the Property
- “Booking Confirmation” — the confirmation email automatically issued to the Guest upon receipt of the Booking Deposit or full payment
3. Bookings & Reservations
3.1 Booking Process
Bookings are made directly via our website, www.villarsapartments.com. Before making payment, you will be asked to read and accept these Terms. A booking is considered confirmed once the required Booking Deposit has been received and a Booking Confirmation has been sent to you by email; until that point, availability is not guaranteed. Between the date of your initial reservation and the start of your holiday, we will contact you at the appropriate dates to request any further payments due, in accordance with the Payment Schedule set out in Section 4.2. The person making the booking warrants that he/she has full authority to do so on behalf of all members of the group and will be deemed to act on behalf of all members of the group.
3.2 Accuracy of Information
You must provide accurate and complete information when making a booking. We reserve the right to cancel bookings made with false or misleading information.
3.3 Minimum Stay
Certain periods may require a minimum stay, particularly during peak season (Christmas, New Year, February half-term, and summer holidays). Minimum stay requirements will be confirmed to you at the time of booking.
4. Prices & Payment
4.1 Pricing
All prices are quoted in Swiss Francs (CHF). The rental rate is fully inclusive of bed linen, bathroom towels, tea towels, electricity, heating, pre / post stay cleaning & laundry, local agent liaison and key handover & collection. Prices exclude local tourist taxes and any optional extras booked separately.
4.2 Payment Schedule
- Booking Deposit: 30% of the total rental rate is due at the time of booking to secure the reservation.
- Balance: The remaining 70% is due no later than 60 days before check-in.
- Late bookings: For bookings made within 60 days of arrival, the full amount is due at the time of booking.
4.3 Damages Deposit Pre-Authorisation
A damages deposit pre-authorisation will be placed on your credit card approximately one week before the start of your holiday; the amount will be confirmed at the time of booking. The pre-authorisation is released within 14 days of check-out, less any deductions for damage or excessive cleaning. Where the cost of any damage or additional cleaning can only be estimated at the time of check-out, we may make a further charge, or provide a refund, once the actual cost is known. Where the cost of damage or additional cleaning exceeds the pre-authorised amount, you will be liable for the outstanding balance.
4.4 Tourist Tax
The Guest must pay a daily tourist tax per person directly to the tourist tax office online. We will organise this with the tourist office, who will contact you by email. Upon payment, Guests are issued with a Welcome Card (Carte de Bienvenue), giving discounted access to local transport and sports facilities for the duration of their stay.
5. Cancellation & Refund Policy
- Booking Deposit: retained by us as a minimum for any cancellation, in addition to any further amount retained under the tiers below.
- 30–60 days before check-in: 50% of the total rental rate will be retained.
- Less than 30 days before check-in: 100% of the total rental rate will be retained.
- No-show: no refund
Cancellations must be submitted in writing by email and will be confirmed by us in return. Where cancellation occurs within the periods set out above, the stated percentage of the total rental rate will already have been received in full by the balance due date and will be retained accordingly. If we successfully re-let the cancelled nights at the full rate, we will refund you the amount retained, less an administration fee. We strongly recommend that Guests purchase comprehensive travel insurance to cover cancellations, curtailment, and other unforeseen circumstances (see Section 8, Travel Insurance).
6. Cancellation by Us
We reserve the right to cancel a booking in any circumstance but, except for force majeure or the Guest’s failure to pay the final balance, will not cancel a booking less than 60 days before commencement of the reservation. Unless the Guest fails to pay the final balance, we will, upon cancellation, return all monies paid; this will be the full extent of our liability and we shall not be liable for any incidental expenses incurred by you as a result of any arrangements you may have made.
7. Check-in & Check-out
- Check-in: from 16:00 unless otherwise agreed
- Check-out: by 10:00 unless otherwise agreed
Early check-in or late check-out may be available on request, subject to availability and possible additional charges. If you expect to arrive significantly later than the check-in time, please let us know in advance.
8. Travel Insurance
We advise, prior to booking with us, that you take out travel insurance for your trip. This insurance should cover cancellation and curtailment, and should also cover any liability you may incur for damage or loss caused to the Property, whether caused accidentally or deliberately by you or any member of your party. Depending on the details of your policy, you may be able to recover cancellation charges, less any excess, from your travel insurance. Medical care in Switzerland can be very expensive, so it is your responsibility to ensure you are adequately covered for all elements of your trip, including medical expenses arising through illness or accident, evacuation and repatriation in an emergency, and loss of holiday monies through cancellation or curtailment for insurable reasons.
Travel insurance is mandatory for all Guests while staying at Chalet Balthazar. Guests, together with their personal property including baggage, are at all times solely at their own risk while staying at Chalet Balthazar.
Guests acknowledge that skiing, snowboarding, hiking, and other alpine or outdoor pursuits are inherently hazardous activities, and that participation — whether alone, with a qualified instructor, or otherwise — is undertaken voluntarily and entirely at the Guest’s own risk. We shall not be held responsible for any injury, loss, or damage arising from a Guest’s decision to take part in such activities.
9. Passports & Visas
It is the responsibility of the Guest to be in possession of a valid passport, visa, and any inoculations required for the duration of the holiday. Many countries require a passport to be valid for at least six months beyond your date of return; please check the passport validity requirements for your destination well in advance of travel. Information about these matters is given in good faith but without responsibility on our part.
We cannot accept any liability if a Guest is refused entry onto any transport or into any country due to failure to carry all required documentation, including an acceptable passport and any necessary visa(s) or health certificate.
10. Guest Obligations
As a Guest, you agree to:
- Allow only members of your own party to occupy the accommodation, and not exceed the maximum occupancy stated in your Booking Confirmation
- Leave the accommodation and all its furnishings and effects in a clean state and in good order
- Advise us promptly of any missing or damaged items and of any damage to the property, and reimburse us for such loss or damage
- Not host parties, events, or gatherings without our prior written consent
- Respect quiet hours between 22:00 and 07:00 and the peaceful enjoyment of neighbours
- Comply with any house rules specific to the chalet
- Obey the laws and regulations of Switzerland while staying at Chalet Balthazar
- Not engage in any illegal activity on the premises
Failure to comply with these obligations will relieve us of all obligations that we may otherwise have under these Terms.
11. Unacceptable Behaviour
Behaviour by any member of your party that we consider unacceptable may result in the immediate termination of your stay. Where this occurs, you will be asked to leave Chalet Balthazar immediately, and neither you nor any member of your party shall be entitled to a refund for the remainder of your stay, nor to any costs, liabilities, or expenses you incur as a result.
12. Pets
Dogs and small pets are only permitted at Chalet Balthazar with the prior consent of the owner, after agreement to our pet policy, and subject to an additional pet fee. Any Guest bringing a pet without prior consent will be asked to leave the accommodation. Guests are responsible for any damage caused by their pets and must ensure pets do not disturb neighbours.
13. Smoking
Smoking (including e-cigarettes and vaping) is strictly forbidden inside Chalet Balthazar. A cleaning surcharge of CHF 500 will apply if evidence of indoor smoking is found.
14. Liability & Damage
14.1 Guest Liability
Guests are liable for any damage to the Property, its contents, or communal areas caused during their stay. Any damage which is not reported to us as soon as reasonably possible after arrival will be presumed to have occurred during your stay, unless you can demonstrate otherwise. Costs will be deducted from the damages deposit pre-authorisation or invoiced separately.
14.2 Our Liability
We do not exclude or limit our liability where it would be unlawful to do so; nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud or fraudulent misrepresentation, or for any other liability which cannot legally be limited. Subject to the foregoing, we do not accept responsibility for happenings or actions outside our reasonable control, such as breakdown of domestic appliances, plumbing, temporary invasion of pests, acts of insurrection, theft, break-in, industrial disputes, floods, natural disasters, pandemics, government restrictions, severe weather conditions, or other events amounting to force majeure. We take great care in the preparation of the information presented to you and every effort is made to ensure accuracy, and we take all reasonable care to maintain the Property in good condition at all times. We shall not be held liable for any injury, loss, accident, delay, inconvenience, or irregularity arising howsoever caused, and our liability, where it arises, is limited to the total amount paid by you for your booking.
15. Complaints
In the unlikely event that you have a complaint about the Property, you must notify us as soon as possible, and in any event within 24 hours of the issue arising, so that we have the opportunity to resolve it during your stay. Failure to notify us promptly may affect any right you may have to compensation.
16. Property Descriptions
Descriptions and photographs of Chalet Balthazar are provided in good faith and are believed to be accurate at the time of publication. Facilities, furnishings, and the local area may change from time to time, and we do not accept liability where such changes occur without prior notice.
17. Modifications by Us
In rare circumstances beyond our control, we may need to make changes to your booking (for example, to room allocation within the chalet). Where we are unable to offer suitable arrangements, you will receive a full refund.
18. Shuttle & Concierge Services
Where offered, shuttle and concierge services are subject to availability. We will make every reasonable effort to fulfil requests but cannot guarantee specific timings due to traffic, weather, or other factors.
19. Intellectual Property
All content relating to Chalet Balthazar, including text, images, and descriptions provided to you, remains our property or that of our licensors and is protected by copyright and intellectual property laws. Reproduction without our prior written consent is prohibited.
20. Data Protection
You consent to us storing personal information about you and other members of your party. We will not share these details with any third parties other than our team who are on hand to assist you during your stay. Your personal data is processed in accordance with our Privacy Policy, which forms part of these Terms.
21. Governing Law & Jurisdiction
These Terms are governed by Swiss law. Any disputes arising from or relating to these Terms shall be submitted to the exclusive jurisdiction of the courts of the Canton of Vaud, Switzerland.
22. Severability
If any provision of these Terms is found to be invalid or unenforceable, the remaining provisions shall continue in full force and effect.
23. Acceptance of Terms
By accepting these Terms during the online booking process and completing payment, you acknowledge that you have read these Terms and accept them without reservation or exception.
